Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. Infonauts Inc. "Discover Love" Sweepstakes ("Sweepstakes") will begin at 12:00am Eastern Standard Time (EST) on October 21, 2008 and end at 11:59pm Pacific Time (PST) on December 31, 2008 ("Sweepstakes Period"). Sweepstakes is Sponsored by Infonauts Inc., 315 5th Ave, Suite 901, New York, NY 10016 (the "Sponsor") who is solely responsible for all aspects of this Sweepstakes.
Eligibility:
Sweepstakes is open only to individuals who are (i) legal residents of the United States and living in one of the 50 United States or the District of Columbia, and (ii) are 18 years of age or older at the time of entry. Employees, officers, directors and representatives of Sponsor and Administrator (see below), its parent company, affiliates, subsidiaries, licensees, service providers, advertising and promotion agencies, those involved in the production, development, implementation or handling of the Sweepstakes, any agents acting on behalf of the above entities, as well as the immediate family members (parents, children, siblings, spouses) and/or persons living in the same household (whether related or not) of each are not eligible to participate in the Sweepstakes. All federal, state and local laws and regulations apply. Void where prohibited, taxed or otherwise restricted by law. Chances of winning depend on the number of eligible entries received during the Sweepstakes Period.
Two Ways to Enter:
1) Participants will be automatically entered into the Sweepstakes by becoming a paid member of BharatMatrimony.com during the Sweepstakes Period. The aforementioned statement applies to all participants who wish to establish a new paid profile, convert a free profile to a paid profile, or for renewal of an existing paid profile. All payments for new memberships must be received by December 31, 2008 in order to be entered into the Sweepstakes.
2) Participants may enter the Sweepstakes by mail by hand-printing on a 3"x 5" card your name, date of birth, address (including ZIP code), day & evening phone numbers and email address, and mailing the card to: "Discover Love" Sweepstakes, 90 Rockwood Place, Rochester, NY 14610. All mail-in entries must be postmarked by December 31, 2008, and received by January 5, 2009. Sponsor is not responsible for lost, delayed, late, incomplete, invalid, unintelligible, illegible, stolen, damaged, misdirected or postage due mail and/or entries and such mail/entries will be disqualified. No photocopies or other mechanically reproduced entries permitted.
Limit one entry per person/household regardless of the entry method. Sponsor reserves the right to disqualify any person or email address that submits more than one entry regardless of entry method. Incomplete entries, or those containing incorrect information, will be voided. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Use of any automated system to submit entries is prohibited and will result in disqualification of all such entries as well as the entrant. By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sponsor which is final and binding in all matters relating to the Sweepstakes. All entries become the property of the Sponsor and none will be acknowledged or returned.
Internet Limitations of Liability: If for any reason, this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Sweepstakes, the Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process (if applicable), and to cancel, terminate, modify or suspend the Sweepstakes in whole or in part, at any time, without notice and award the prize using all non-suspect eligible entries received as of the termination/suspension date. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor also is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure or delay of any email or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof. Sponsor is not responsible for any damage to an entrant's system which is occasioned by participating in this Sweepstakes or by downloading any information necessary to participate in the Sweepstakes. Sponsor also is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of the entries in the Sweepstakes. Any dispute or claim arising out of the play of this Sweepstakes, or any disputes with site users which arise as a result of the use of this website, shall be governed by the laws of the State of New York, without respect to conflicts of laws principles. Any such claim shall be brought and maintained in the federal or state courts of the State of New York. If any provisions of the Official Rules are determined by a court of competent jurisdiction to be invalid or unenforceable, such determination shall not affect the validity or enforceability of any other provision.
Caution: Any attempt to deliberately damage any website or undermine the legitimate operation of the sweepstakes is a violation of criminal and civil laws and should such an attempt be made, the sponsor reserves the right to seek damages or other remedies from any such person(s) responsible for the attempt to the fullest extent permitted by law.
Prizes: One (1) Grand Prize winner will receive a Diamond Ring that has an Approximately Retail Value (ARV) of $11,400. The Diamond Ring is courtesy of Kohinoor Diamonds and is part of the La Royale Collection with the diamonds specially set in a Hearts and Arrow formation. Two (2) 1st Prize winners will receive a Cruise for two people to St. John's, courtesy of Maharaja Cruises. Cruise consists of an ocean view cabin and will depart from New York City on August 6, 2009 and return on August 10, 2009. Prize has an ARV $1,500 each. Travel restrictions may apply, cruise dates and departure sites are subject to change. Once travel is booked, no changes or cancellations will be accepted. No extensions or exceptions shall apply or be available. 1st prize winners must provide own transportation for themselves and their travel companion to and from gateway city. It is the responsibility of the 1st prize winner and his or her travel companion to arrive at the designated gateway city in time for their cruse to St. Johns, with proper travel documentation (including proper identification). Certain travel and security restrictions may apply and it is the responsibility of the 1st prize winner and his or her companion to comply with all travel, security and other laws, and regulations, which apply to them. Winner and his/her guest will be solely responsible for all other expenses not specifically set forth herein including but not limited to, income taxes on the value of the prize, gratuities, parking fees, laundry service, food, alcoholic beverages, merchandise, souvenirs, telephone, in-room services, tips and any other incidentals. Winner and travel companion must execute liability / publicity releases prior to issuance of travel documents. If travel companion is a minor, parent or legal guardian must sign and return release and accompany minor on trip. Travel restrictions, conditions and limitations may apply.
One Hundred (100) 2nd Prize winners will receive a one-month paid membership to BharatMatrimony.com (ARV $20). ASC will be responsible for the Grand Prize winner selection/verification/ notification. ASC will provide the list of winners to the Sponsor for prize fulfillment.
The Sponsor reserves the right at its sole discretion to substitute any prize package with another prize of equal or greater value.
Drawing and Notification: The winner will be selected from among all eligible entries received by either entry method, in a random drawing conducted on or about January 15, 2009 by American Sweepstakes & Promotion Co. ("the Administrator") an independent judging organization, whose decisions are final and binding in all matters relating to this Sweepstakes. Odds of winning will depend on the total number of eligible entries received by either entry method. Potential winner will be notified by phone and/or mail. Upon initial notification and verification of potential winner, confirmation will be sent to winner in writing via USPS mail, or other home delivery service of Sponsor's choice.
Prize Conditions: The winners are solely responsible for all applicable federal, state and local taxes and/or any other fees/costs associated with the prize or receipt of the prize. The Grand Prize and 1st Prize winners will be required to sign and return an Affidavit of Eligibility and Liability / Publicity Release (unless prohibited) within 14 days of written notification or prize winner will be disqualified. Travel companions of the 1st Prize winners must also execute and return a travel release. If travel companion is a minor, parent or legal guardian must sign and return release and accompany minor on the trip. In the event of noncompliance with the Official Rules, if a winner cannot be reached at the address/phone number on winner's entry within 5 days of the first attempt, or if the prize or prize notification is returned as unclaimed or undeliverable, an alternate winner will be selected. The prize will be only awarded to a verified winner. The winner's entry and acceptance of the prize constitutes permission (except where prohibited) for the Sponsor to use said winner's name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation.
Terms & Conditions: By entering the Sweepstakes, entrants agree to release Sponsor and its parent company, subsidiaries, affiliates, retailers, distributors and advertising and promotion agencies, and its and each of their respective directors, officers, employees, shareholders and agents from any and all liability, loss, damage or injuries of any kind sustained in connection with their participation in the Sweepstakes or from their acceptance, receipt, possession and/or use or misuse of the prize, or for any typographical or other error in the printing, offering or announcement of the prize. Entrants further acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee express or implied, in fact or in law, relative to the prize, including, but not limited to, its quality or fitness for a particular purpose. Any person attempting to defraud or in any way tamper with the Sweepstakes mechanics and/or implementation will be prosecuted to the fullest extent of the law. By participating, entrants agree to waive any right to claim ambiguity in the Sweepstakes or these Official Rules. Sponsor reserves the right to disqualify any entrant that Sponsor determines, in its sole discretion, violates these Official Rules. By participating in the Sweepstakes, entrants agree that the Sponsor has the right to send marketing, promotional, or other materials and information from the participating marketing partners.
Winners List: To request the name of the winner, please send a self-addressed, stamped business size envelope, by February 15, 2009, to: ASC/"Discover Love" Sweepstakes Winners List, 300 State Street, Suite 402, Rochester, NY 14614. VT residents may omit return postage.
